The Calcutta Metropolitan Water And Sanitation Authority Act, 1966
Kolkata Metropolitan Water & Sanitation Authority was established on 26th May, 1966 under West Bengal Act XIII of 1966 duly passed by the West Bengal Legislatures and assent of the President was published in the Calcutta Gazette. Extraordinary of the 26th May 1966.
In exercise of the power conferred by Section (1), and in particular, by Clause (f) of Sub-section (2) of Section 93 of the Kolkata Metropolitan Water & Sanitation Authority Act, 1966 (W.B. Act XIII of 1966) the KMW&SA framed two Regulations with the prior approval of State Govt. namely KMW&SA (Service & Recruitment) Regulations 1968 and KMW&SA (Accounts Regulations 1968).
K.M.W.&S.A. had been running smoothly with the powers & functions vested by the Act and at the same time Controlling finance and administration with the help of two Regulations as mentioned above but State Govt. superseded the Board of Directors of this Authority with effect from 12th February 1974 vide order no. 859-T&CP/PWD/A-2/74 dt. 11/02/1974 and vacated the Offices of Directors and members of the Authority. Extension of the period of super-session has taken place a number of times and the period of super-session till continues and as a result of this CMD Authority is discharging the duties and responsibilities as provided in KMW&SA Act. All the officers and other employees of the Authority continuing in office immediately before the date of the order of super-session of the Board of Directors are deemed to be employed by KMDA on such terms and conditions not being less advantageous than what they were entitled to immediately before the date of super-session.
KMDA in its 37th meeting held on 25th March, 1974 framed a Regulations namely KMDA (Management of KMWSA) Regulations, 1974 and created a post namely, Officer on Special Duty to deal with the affairs of KMW&SA under section 3 of the KMW&SA Act 1966 (W.B. Act XIII of 1966) on its behalf.
